Online Cake Terms and Conditions

By placing an order with Butter, you agree to comply with these Terms and Conditions. Please read them carefully.

1. General Conditions

1.1  These Terms and Conditions apply to all website users and customers who engage with our services or products. By placing an order, you agree to these terms.

1.2 Butter operates under the laws of New South Wales, Australia.

1.3 These terms and conditions apply to cakes ordered through Butter’s website. For custom cakes seperate terms and conditions will be provided before your order is confirmed.

1.4 “Order date” as referred to throughout these terms refer to the date your cake is due to be picked up or delivered.

2. Orders and Payments

2.1 All payments will be made through the online checkout on our website

2.2 No order is confirmed unless full payment has been made

2.3 Order Date must be selected from the available dates at checkout. If a date is blacked out on the calendar we are not accepting orders for this date.

2.4 All orders must be placed and paid for with at least 3 days before the Order Date

2.5 If you place an order that does not comply with these terms your order will be refunded minus a $50 admin fee

3. Allergies and Dietary Requirements

3.1 While we take precautions to avoid cross-contamination, our cakes are prepared in a kitchen that handles common allergens such as nuts, eggs, gluten, and dairy. All baked goods contain gluten, dairy and eggs. 

3.2 Customers must inform us of any specific dietary requirements or allergies at the time of placing the order.

3.3 We are not liable for allergic reactions caused by undisclosed allergies or misuse of our products.

4. Cake Storage and Handling

4.1 All customers will receive a cake storage and handling guide with the confirmation of their order

4.2 Failure to follow these guidelines may affect the quality of the cake, and Butter will not be held responsible for any resulting issues.

5. Refunds and Cancellations

5.1 Cancellation requests must be made in writing. Refunds are subject to the following conditions:

   - Cancellations made 7 or more days before the order date will receive a partial refund, minus 50% of the total order cost. 

   - Cancellations made within 7 days of the order date are non-refundable

5.2 Refunds will not be provided for change-of-mind requests or dissatisfaction based on subjective taste preferences.

5.3 Under no circumstances will refunds be issued for cakes that have been consumed. If you believe there is something wrong with your cake at least 80% of the cake must be returned to Butter for inspection.

5.3 In the unlikely event that Butter cannot fulfil your order due to unforeseen circumstances outside of our control, a full refund will be issued.

6. Liability

6.1 Our liability is limited to the cost of the product purchased. We are not liable for any indirect, consequential, or incidental damages.

6.2 We are not responsible for damages to cakes once they have been collected or delivered.

7. Delivery

7.1 Delivery is available to the areas listed on our website. Each delivery zone has its own fee applicable based on the distance from the Butter kitchen

7.2 A delivery zone must be selected and added to your order at the time of purchase. If the delivery zone you have selected does not match to the provided delivery address you will be invoiced for the difference plus a $10 admin fee.

7.3 If you wish to add delivery after your order has been confirmed please contact us to confirm availability. Additional fees will apply for delivery requests made within 7 days of the order date.

7.4 Customers are responsible for ensuring someone is available to receive the order during the delivery window (as selected by the customer during checkout). A specific delivery time cannot be guaranteed. If no one is available to receive the cake it may be left at the delivery address unattended. Butter is not responsible for any damage that results from the cake being unattended. If Butter determines that there is no suitable location to leave the cake it will be returned to the Butter kitchen and the customer will be responsible for arranging pick up within Butter’s standard pick up hours. If the customer cannot pick up the cake in the specified time the cake will be forfeited and no refunds will be issued.

8. Collection

8.1 Collection address will be provided with the order confirmation after payment has been made

8.2 Collections must be made within the time period specified in the customer’s order confirmation (as selected by the customer at checkout)

8.3 There is no guarantee the Butter kitchen will be staffed outside of these hours and if a customer fails to collect their cake at the specified time it will be forfeited and no refund will be issued.

8.4 Butter will not be held responsible for any damage to the cake after it has left our premises. Customers must drive carefully with their cake and follow the storage instructions provided.
